Laws Enacted within Arcanum Draconis

This Writ is to allow our citizens to know and understand the current Laws of Arcanum Draconis, and areas in which these laws may be enacted.

<span style=”text-decoration: underline;”>The Domain of Arcanum Law:</span>
The Domain of Arcanum Draconis extends to the city of Arcanum Draconis itself, it’s immediate airspace, an area of sea encompassing three miles outside of the coast of the city of Arcanum Draconis, the Town of Theldor in the outlying province, and the roads and airspace passable between both locations.

<span style=”text-decoration: underline;”>Divisions and Persons able to enact Laws of Arcanum Draconis:</span>

The Arcanum Royal Guard and City Guard, as well as members of the Royal Family, may be called upon to act as peace officers in times of need in public forum.  These persons may, in instances of extreme measures, enable a temporary title of deputy to be placed upon persons of their choosing.  This will be written into guard reports as needed by the person, or persons, enabling arrest or investigation of or for a crime as committed.

Trials will be held in public forum with members of the Royal Family and Guard of Arcanum presiding as needed.  In all matters, those charged with crimes are considered innocent until otherwise proven.

The Laws of Arcanum are as follows:

<span style=”text-decoration: underline;”>Personal Crimes</span> – “Offenses against the Person”: These are crimes that result in physical or mental harm to another person. Personal crimes include:

Assault – The act of purposefully and knowingly issuing a physical attack on a citizen or protected guest of Arcanum. This may be a felony or misdemeanor depending on the severity and constitutes a punishment including fines up to twenty-five thousand gold, loss of title if held and jail time up to twenty-five years.
Battery – The act of purposefully and knowingly issuing physical contact with a citizen or protected guest of Arcanum not wishing said contact. This may be a felony or misdemeanor depending on severity and constitutes punishment including fines up to five thousand gold, loss of title if held and fail time up to five years
False Imprisonment – The act of unlawfully detaining a citizen or protected guest of Arcanum without lawful ability or issuance. Is considered a misdemeanor and will result in heavy fines and loss of status if carrying a title.
Kidnapping – The act of abduction by force against the will of a citizen or protected guest of Arcanum. Is considered a felony crime in all accounts and will constitute punishment including fines, loss of title if held and jail time up to fifty years.
Homicide – Homicide includes variations of this crime such as first and second degree, murder, involuntary manslaughter, and vehicular homicide (Use of airship to issue unwarranted attack) against a citizen or protected guest of Arcanum. Is considered a felony in all instances and carries a punishment of Heavy Fines up to five million gold, mandatory loss of title if held and inability to re-obtain a held title, jail time to include incarceration for life or capital punishment including death.
Rape – Rape, statutory rape, sexual assault and other offenses of a sexual nature are considered felony crimes no matter whom they are against while within Arcanum territory. The penalty for this can include Heavy Fines up to Two Million Five Hundred Thousand Gold, Mandatory loss of Title if held and inability to re-obtain a held title, and jail time to include incarceration for life.

<span style=”text-decoration: underline;”>Property Crimes</span> – “Offenses against Property”: These are crimes that do not necessarily involve harm to another person. Arcanum does not allow slavery and does not currently recognize the rights of slave owners within the boundaries of Arcanum Law.  Slaves in Arcanum Draconis are considered to have full rights and liberties as guests of Arcanum.  Instead, they involve an interference with another person’s right to use or enjoy their property. Property crimes include:

Larceny (Theft) – This includes the theft of property of a personal nature or by property of the state. This can be considered felony or misdemeanor depending on the nature of the theft. Penalties can include Fines up to ten times the value of the stolen property and jail time up to ten years.
Robbery (Theft by Force) – Note: this is also considered a personal crime since it results in physical and mental harm. A more serious allegation and often is considered felony in nature. Punishment can include fines up to twenty-five times the value of the item stolen and jail time up to fifty years.
Burglary – Unlawful entry into a property with the intent to commit a crime. Can be considered either a misdemeanor or a felony depending on severity. Penalties can include fines up to five times property damage value and jail time up to twenty years.
Arson – The act of knowingly setting fire to personal or state property. Is considered either a misdemeanor if on personal property with recoverable damage, or a felony if the damage is irrecoverable or it is done on state property. Penalties can include fines up to fives times property damage value and jail time up to fifty years.
Embezzlement – The act of knowingly taking from the stores or funds of a business you are employed under. Is considered a misdemeanor or felony depending on the severity and can constitute fines up to twice the value of the stolen amount and jail time up to twenty-five years.
Forgery – The act of knowingly signing legally a document under the guise of another person, living or not, without consent. Is in most cases considered a misdemeanor but can be a felony if this is done on a form for the state. Penalties include fines up to ten thousand gold and jail time for up to five years
False pretenses – The act of misrepresenting a fact or set of facts in order to acquire someone else’s property (I.E. Claiming to be a land solicitor for the state and not actually being one). Is a felony crime and carries a fine up to three times the property value, loss of title if held, and jail time up to twenty-five years.
Receipt of stolen goods – Knowingly receiving goods from another known to be of a stolen nature. (This is also known as ‘Fencing Goods’). Is a misdemeanor or felony crime depending on the severity and constitutes punishment including fines up to three times the value of the stolen item and jail time of up to twenty-five years.

<span style=”text-decoration: underline;”>Inchoate Crimes</span> – “Inchoate” translates into “incomplete”, meaning crimes that were begun, but not completed. This requires that a person take a substantial step to complete a crime, as opposed to just “intend” to commit a crime. Inchoate crimes include:

Attempt – any crime that is attempted like “attempted robbery” or “attempted assault”. In most cases is considered a misdemeanor crime and can constitute penalty of fines up to one hundred thousand gold or jail time up to five years.
Solicitation – Is not wholly considered a crime in matters of prostitution but is discouraged. If continued attempts are reported, may be considered a misdemeanor and constitute a punishment of fines up to twenty-five thousand gold.
Conspiracy – Defined as the act of secretly planning by way of a group to perform an unlawful or harmful act. Can be considered a misdemeanor or felony depending on the severity of the crime intended and carries a penalty to include fines up to one million gold, loss of title if held and inability to re-obtain a title, and jail time up to fifty years.

<span style=”text-decoration: underline;”>Statutory Crimes</span> – A violation of specific state statutes concerning the welfare of citizens. Below are examples:

Alcohol-related crimes such as Operating a Vehicle while under the Influence: (Mostly concerning Airships) Penalties can be a misdemeanor or felony depending on if additional charges are filed in matters of damage to personal or state property. Can include penalties of fines up to five hundred thousand gold, temporary loss of title for up to one year, and jail time for up to one hundred eighty days.
Selling alcohol to a minor – Legal drinking age within Arcanum is listed at eighteen years of age. Selling, or knowingly distributing alcohol or spirits, to a person under the age of eighteen is considered a misdemeanor offense for the first two violations, and a felony after. Penalties for this can include fines up to five hundred thousand gold, loss of held title if applicable, and jail time of up to five years.
